2010年国家出台房产新政后,由于对法律规定及司法解释理解与执行的不统一,导致全国各地对房产新政引发的退房案件裁判各异,有违法治原则。原因在于民意对司法的侵蚀,使司法不能有效回应;法律规则本身的纠结影响了裁判的统一。司法不仅应考虑社会效果,更要考虑社会预期及裁判导向。
After the State introduced the New Deal of Real Estate in 2010, due to the non-uniform understanding and enforcement of the legal interpretation and judicial interpretation, the judgment on the check-out cases triggered by the New Deal of the Real Property throughout the country is different and violates the principle of the rule of law.
