接触控制技术措施是防止未经允许的对作品信息接触的事前预防的电子自助手段,而版权保护技术措施是防止非法的作品信息复制、传播等版权侵权的电子自助。技术措施要实现的本质目的不是防止版权侵权,而是通过接触控制实现最大程度的信息控制,确保信息的稀缺性。与版权专有权的目的一致,版权法保护技术措施的内在逻辑是保障版权人通过排除他人对作品信息的不正当接触和使用而充分实现经济收益,以激励更多的作品创作。
The technical measures of contact control are electronic means of preventing unauthorized access to work information beforehand, while the technical measures of copyright protection are electronic self-help to prevent copyright infringement such as duplication and dissemination of illegal work information. The essential purpose of technical measures to achieve is not to prevent copyright infringement, but to achieve the maximum degree of information control through contact control and ensure the scarcity of information. In keeping with the purpose of copyright exclusive rights, the inherent logic of copyright law protection of technical measures is to ensure that copyright owners can fully realize their economic benefits by excluding others from improper access to and use of works’ information in order to encourage more work creation.
