房屋承租人优先购买权制度在我国经历了一个较长时间的立法过程,虽然最高人民法院出台了关于房屋出租案件的司法规定,使房屋承租人优先购买的权利体系得到健全,可还是没能对该项权利的性质、行使条件、侵权损害赔偿的救济方式和数额、“合理期限”等内涵及其法律性质进行明确辨析,导致在房地产纠纷中仍然存在着诸多问题。文章从侵权损害赔偿这一角度入手,分析房屋承租人优先购买权的性质、变迁以及明确损害赔偿责任的有关措施,以期对房屋承租人优先购买权制度的完善有所裨益。
