在蒙古族古代法制史研究领域,充分利用元以来汉籍文献日趋显得十分重要。汉籍蒙古族习惯法文献有三大特点,文献体裁丰富、时间跨度绵长、地域覆盖广阔。有元以来的汉籍文献卷帙浩繁,内容丰富包括刑事法律规范,民事法律规范,社会组织方式,婚姻家庭习惯法。事涉蒙古族习惯法的内容十分丰富,我们中窥见蒙古族习惯法之一斑,并可借此补充蒙古文文献的缺漏,从而完善这方面的研究工作。
In the field of ancient legal history research in Mongolia, it is very important that the Chinese literature has become more and more fully utilized. Chinese Mongolian customary law literature has three major characteristics, the literature is rich in genre, long time span, vast geographical coverage. Since the Yuan Dynasty, the volume of Chinese literature is numerous and varied. The contents are rich in criminal law, civil law, social organization, marriage and family customary law. Concerning Mongolian customary law, the content is very rich. We have a glimpse of Mongolian customary law as one of the spots, which can be used to supplement the omission of Mongolian literature, so as to perfect the research work in this field.
