中国工会十六大新修订的《中国工会章程》指出,各级工会组织应当组织和代表职工开展劳动法律监督。在加强和创新社会管理新形势下,各级工会必须加强监督能力建设,推进劳动法律法规落实和劳动合同集体合同的履行,发展和谐的劳动关系。一、工会劳动法律监督的性质定位(一)工会劳动法律监督有明确的法律依据。《劳动法》《劳动合同法》都将(各级)工会对用人单位遵守劳动法律、法规的情况,用人单位履行劳动合同、集体合同的情况进行监督的内容写入“监督检查”章节中。《福建省
