我国刑事诉讼法的立法精神需要一系列配套的诉讼制度、证据制度等来支撑和实现。在借鉴英美对抗制诉讼模式下的证据规则,建立同我国诉讼相适应的证据制度过程中,作为英美证据规则中最重要规则之一的品格证据规则并没有得到充分的研究。
The legislative spirit of China’s Criminal Procedure Law needs a series of supporting litigation system and evidence system to support and realize. In drawing lessons from the rules of evidence under the Anglo-American adversarial litigation model and establishing the evidence system that suits our litigation, the rules of evidence of character as one of the most important rules in the Anglo-American evidence rules have not been fully investigated.
