海上运输承运人责任豁免制度,是指在承运人责任期间内货物灭失、损坏或延迟造成损失,承运人原本应该对此承担赔偿责任,但是由于出现法定原因,而免除其赔偿责任的一种制度。它反映了船货双方的力量对比,直接关乎船货双方的利益。本文通过对比《海牙—维斯比规则》、《汉堡规则》和《鹿特丹规则》对承运人责任豁免的规定,评价《鹿特丹规则》承运人责任豁免规定的合理性和科学性,提出我国应该借鉴《鹿特丹规则》修改《海商法》下承运人责任豁免制度。
