众所周知,贸易术语作为一种交货条件早已构成国际贸易单价的一个组成部分。为了使贸易术语有一国际性的统一解释,以明确买卖双方的责任,国际上一些学术和商业团体对此作出了努力,其中国际商会制订的《国际贸易术语解释通则》(以下简称《通则》)就是影响最大的一种。1990年4月,国际商会又公布了《通则》的1990年修订本。本文拟就修订《通则》的主要原因之一——电子数据交换,即EDI(Electronic Data Interchange)的日益频繁运用——作些介绍,并对1990年修订本是如何把原来的贸易术语进行改造,使之适合EDI的需要谈一些看法。
As we all know, trade terms as a kind of delivery conditions already constitute an integral part of the unit price of international trade. In order to have an international uniform interpretation of trade terms, and to clarify the responsibilities of buyers and sellers, some international academic and commercial organizations have made efforts, including the “General Principles for International Trade Terms” (hereinafter referred to as “General Rules”) formulated by the International Chamber of Commerce. It is the most influential one. In April 1990, the International Chamber of Commerce announced the 1990 revised edition of the “General Principles.” This article intends to introduce one of the main reasons for the revision of the “General Regulations”, electronic data interchange (EDI), which is the increasingly frequent application of Electronic Data Interchange (EDI), and how the 1990 revised version will transform the original trading terms. To make it suitable for EDI needs to talk about some of the views.
