我国生态补偿立法正处于发展阶段,虽然取得了不少进步,但也存在补偿主体和受偿主体不明确、补偿标准较低、补偿方式单一、补偿程序欠缺等不足。从生态补偿主体、标准、方式以及程序等方面对我国现行生态补偿立法进行整理和分析有利于深化对生态补偿理论的研究,完善生态补偿立法。
Although China’s legislation of ecological compensation is in its developmental stage, a lot of progress has been made. However, there are also some problems such as the indeterminate compensation subject and the indemnified subject, the low compensation standard, the single mode of compensation and the lack of compensation procedures. The compilation and analysis of the current legislation of ecological compensation in our country from the aspects of the subject, standard, method and procedure of ecological compensation are helpful to deepen the research of ecological compensation theory and improve the legislation of ecological compensation.
