高校管理权是各国法律承认和保护的一项自治权利。在高校学生管理中,高校与大学生之间既有隶属型法律关系,又有平权型法律关系。高校管理权有权力和权利双重属性。作为权力,具有单方性、强制性等特点,容易与学生权利发生冲突;作为权利,被管理者滥用时,也会侵害学生权利。
