2003年5月28日,国务院第9次常务会议通过了《物业管理条例》(以下简称《条例》),自2003年9月1日起正式施行。这是我国出台的第一部关于物业管理的行政法规,也是我国第一部面向社会公开征求意见的行政法规。物业管理是指业主通过选聘物业管理企业,由业主和物业管理企业按照物业服务合同约定,对房屋及配套的设施设备和相关场地进行维修、养护、管理,维护相关区域内的环境卫生和秩序的活动。《条例》分为7章70条,主要对业主及业主大会的权利义务、前期物业管理、业主入住后的物业管理以及物业的使用和维护等四个方面作出了具体的规定。《条例》的出台,必将极大地改善长期以来房地产开发商、物业公司和业主之间“剪不断、理还乱”的“冤家”关系,同时,对维护业主的合法权益,合理规范物业公司的行为也将起到良好的推动作用。
