通过分析合作社的产生与发展,明知合作社是市场经济的产物。合作社的本质是在其内部成员之间进行资源的优化配置。而合作社的法律属性集中的体现为合作社基本原则的归纳综合的五个方面。各国各地区也都进行了合作社的立法,但是存在不同的立法模式。在分析各种立法模式之后,提出我国应该采用综合立法的方式:即制定统一的合作社基本法,以促使我国合作社的发展。
By analyzing the emergence and development of cooperatives, we know that cooperatives are the product of market economy. The essence of cooperatives is to optimize the allocation of resources among their internal members. However, the legal attributes of cooperatives are concentrated in five aspects: the general principles of cooperatives. Various countries and regions have also carried out cooperative legislation, but there are different legislative models. After analyzing various legislative modes, this article proposes that our country should adopt a comprehensive legislative approach: to draw up a unified basic law of cooperatives so as to promote the development of cooperatives in our country.
