2016年2月国务院法制办公室发布了《中共中央国务院关于进一步加强城市规划建设管理工作的若干意见》,该意见在社会上引起了广泛的讨论,一方面是民间人士从安全、私密的角度反对拆墙;另一方面是业内的专家学者从私产、物权等法律的角度来论证该意见的可行性,众说纷纭、莫衷一是。文章提出一个新的规划理念,可以同时兼顾上述两方的观点,也就是“流动的围墙”。建议将小区内的主干道在城市的早高峰、晚高峰时间段内定时开放,充当缓解交通压力的“泄洪路”。把路权开放,在交通流量高峰期扩大城市公共路网的密度,而在其他时间段则关闭主干道,将之变为小区内的私有道路。这种方法可以有效的兼顾上面的两种观点,同时也可以起到缓解城市交通的作用。
In February 2016, the Legislative Affairs Office of the State Council promulgated “Several Opinions of the Central Committee of the Communist Party of China and the State Council on Further Strengthening the Management of Urban Planning and Construction”. This opinion has aroused widespread discussion in the community. On the one hand, private individuals oppose the demolition from a safe and intimate perspective Wall; on the other hand is the industry experts and scholars from the perspective of private property, property rights and other legal arguments to demonstrate the feasibility of this opinion, divergent views, incomprehensible. The article proposes a new concept of planning that takes into account both the above two perspectives, that is, “the mobile wall.” It is suggested that the arterial roads in the district be regularly opened in the morning peak and late peak hours of the city to act as a “flood discharge road” for alleviating traffic pressure. Open the right of way, expand the density of urban public road network at the peak of traffic flow, and turn off the main road at other times to turn it into a private road within the district. This method can effectively take into account the above two points of view, but also can play a role in alleviating urban traffic.
