优者危险责任原则,不是非机动车方的免责牌。酒后驾车、疲劳驾车、超速行车、带病行车等被人们称之为马路杀手。由此,人们对当今交通安全环境有一句生动评语:“车祸猛于虎。”然而,反观众多的交通事故,当人们指责机动车方违章行车的同时,不可忽略的一个重要因素是,相当多的非机动车方,无视交通安全法规的规定,违章行车,结果酿成悲剧。最近,海安县人民法院判决的三起公安机关未认定责任的交通事故人身损害赔偿案,认定有重大过错的非机动车方负事故的主要责任。
