★案情简介职工陈某于1999年1月到某铸造加工厂工作,工作岗位为叉车工,约定月工资标准为1200元,另加发产品奖。2009年11月,受金融危机影响,企业与陈某协商解除劳动关系。在支付经济补偿金阶段,双方就补偿金的计算依据——月工资标准发生了较大分歧:陈某坚持工资加奖金、津贴每月可领取1800元,企业却主张陈某每月工资只有1200元。在仲裁审理阶段,仲裁委要求企业5日内提供陈某的考勤表和工资表,但企业在指定的期限内却没有提供。在调解不成的情况下,仲裁委最后按照陈某主张的每月1800元为基数计算了陈某的经济补偿金。
