我国民法深受前苏联民法的影响,尽管我国现行民法进行了较大的修正,将二者的地位由不对称变为平行,但仍将人身关系置于财产关系之后。中国未来的民法典,不仅要调整人身关系,还要将其置于财产关系之前,“认真地寻找丢失的人格”[1]。本文主要阐述的民法调整的人身关系的重要性及其特点,以便人们更好地了解人身关系在民法调整中的地位。
The civil law in our country is deeply influenced by the civil law of the former Soviet Union. Although the existing civil law in our country has been greatly amended, the status of both of them will be changed from asymmetry to parallelism, but the personal relationship will still be placed behind the property relations. China’s future civil code should not only readjust personal relationships, but also put it before property relations and “conscientiously look for lost personalities” [1]. This article mainly expounds the importance and characteristics of the personal relationship regulated by the civil law so that people can better understand the status of personal relationship in the adjustment of civil law.
