瑞士民事调解制度的发展历程并不长,在很大程度上还是一个新兴事物。受加拿大家事调解传统的影响,瑞士调解制度首先萌芽于家事法律领域。随着调解制度在瑞士诸多法律领域的蓬勃发展以及调解自身重要性的日益增强,通过民事程序法对调解制度加以规制逐渐提上议事日程。2011年1月1号生效的《联邦民事诉讼法》(Federal Code on Civil Procedure,以下简称CCP)对瑞士民事程序中的调解制度进行统一规范,并鼓励各州积极适用调解来解决民事纠纷,由此揭开调解在瑞士发展的新篇章。
The development of the civil mediation system in Switzerland is not long, to a large extent still an emerging phenomenon. Affected by the traditional Canadian family mediation, the Swiss mediation system first sprouted in the field of family law. With the vigorous development of the mediation system in many legal fields in Switzerland and the growing importance of mediation itself, it has gradually been put on the agenda by regulating the mediation system through the civil procedural law. The Federal Code of Civil Procedure (CCP), effective January 1, 2011, regulates the mediation regime in Swiss civil proceedings and encourages the states to actively apply mediation to resolve civil disputes, whereby Unveil a new chapter in the development of conciliation in Switzerland.
