最新修改的《刑事诉讼法》第一次将隐匿身份侦查写入法律,同时在侦查实践活动中,隐匿身份侦查的手段也被侦查机关广泛运用。然而隐匿身份侦查的具体形态及规范要求在法律中尚未被明确规定。本文就隐匿身份侦查的实施主体、适用对象、犯罪界限与责任问题、实施程序要求、证据可采性标准与进行探索,旨在多方面构建隐匿身份侦查的制度。
The latest revision of the “Criminal Procedure Law” first concealed the identity of the investigation into the law, at the same time in the investigation of practical activities, the means of concealing the identity of the investigation has also been widely used by the investigating authorities. However, the specific form of occult identity investigation and regulatory requirements in the law has not yet been clearly defined. This article probes into the implementation subject, applicable objects, criminal limits and liability issues, implementation procedure requirements and admissibility standards of identity detection, and aims to construct the system of identity detection in many aspects.
