房屋买卖不破租赁与房屋承租人优先购买权最初存在宗旨为保护房屋承租人生存权利,但在实际实施过程中非但没有尊重此原则立法精神,反而更加严重损害承租者利益,并且忽视房屋所有人与新继受人利益,激发了三者矛盾之争。随着整个社会公平意识的提高,我们不仅需要以更加合理方式尊重制度存在宗旨,保护社会最底层者居住利益,更需要协调房屋出租人、承租人与新继受人之间利益关系,淋漓尽致地发挥上述制度效用。
