食品安全社会共治的理念已经被广泛接受。“共治”需要众多主体的“协同”一致参与食品安全风险治理活动。食品安全社会共治的主体是食品安全风险规制的主体和规制受体二元结构。各主体的行为不仅对食品安全风险的规制有影响,也影响着食品安全社会共治法律制度的建设和制度的实效。从主体规制的角度出发,提出“人人参与”、“人人负责”、“人人共享”食品安全社会共治法律制度构想。这个制度构想是:众多食品安全主体综合运用多种方式积极参与食品安全风险管理与控制,以解决食品安全信息不对称引发的食品安全问题。通过各个主体享有相应的主体权利,落实相应的主体责任,最终实现食品安全风险规制的目的。
The concept of co-governance of food safety has been widely accepted. “Commoner ” requires many subjects “Synergy ” unanimously involved in food safety risk management activities. The main body of food safety social co-governance is the subject of the regulation of food safety risk and the regulatory dual structure of the recipient. The behavior of each subject not only has an impact on the regulation of food safety risks, but also affects the construction of the legal system of food safety social co-governance and the effectiveness of the system. From the perspective of the regulation of the main body, we put forward the conception of the legal system of “social participation of all”, “responsible for everyone”, “sharing of all” and “social security for all”. The concept of this system is that many food safety agents are actively involved in food safety risk management and control in a variety of ways to solve the food safety problem caused by the asymmetric information of food safety. Through each subject to enjoy the corresponding rights of the main body to implement the corresponding main responsibility, and ultimately achieve the purpose of food safety risk regulation.
