背景资料《公路建设市场管理办法》(交通部1996年4号令)与《公路法》、《行政处罚法》、《建设工程质量管理条例》等法律法规以及交通部近期出台的一些规章有很多不一致,2000年以来出台的《公路建设市场准入规定》、《公路建设四项制度实施办法》、《公路工程施工招标投标管理办法》与《公路建设市场管理办法》《交通部1996年4号令)有很多重复。另外,目前公路建设面临新形势、公路建设市场依然混乱,迫切需要进行管理和制度的创新,加强市场监管、精简行政审批、规范市场行为、杜绝腐败。
Background Information The Measures for the Administration of the Road Construction Market (Order No. 4 of the Ministry of Communications of 1996) has a lot of inconsistencies with the laws and regulations such as the Highway Law, the Administrative Punishment Law and the Regulations on the Administration of Construction Quality and the recent regulations promulgated by the Ministry of Communications The Provisions on Market Access for Highway Construction since 2000, the Measures for the Implementation of Four Systems of Highway Construction, the Measures for the Administration of Bidding and Bidding for Highway Construction Projects and Measures for the Administration of the Road Construction Market, Order No.4 of 1996 of the Ministry of Communications) There are many repetitions. In addition, the current highway construction is facing a new situation, the road construction market is still chaotic, there is an urgent need for innovation in management and system, strengthen market supervision, streamline administrative examination and approval, standardize market behavior and eliminate corruption.
