量刑建议权,是检察机关在刑事诉讼过程中,结合被告人的犯罪性质、犯罪情节、主观恶性、人身危险性等因素,依法就被告人应被判处的刑罚种类及刑期,向法院提出具体建议的权力。2010年2月,最高人民检察院公诉厅下发《人民检察院开展量刑建议工作的指导意见(试行)》,就开展量刑建议作出了具体规定。山东省新泰市检察院认真贯彻高检院关于量刑建议工作的指导意见,积极推进检察机关提起公诉案件量刑建议工作,取得了一定的成效。但是,由于立法的不完善及其他诸多因素,使得检察机关的量刑建议尚未达到预期法律效果。如何在现行法律框架下有效开展量刑建议工作,是当前亟待深入研究的问题。

Xintai City Procuratorate of Shandong Province conscientiously implemented the Guiding Opinions of the Supreme People’s Procuratorate on the work of sentencing recommendations and actively promoted the procuratorial organs’ proposal of sentencing the sentencing cases and achieved some success. However, due to imperfect legislation and many other factors, the procuratorial sentencing recommendation has not yet reached the expected legal effect. How to carry out the sentencing recommendations effectively under the current legal framework is an issue that urgently needs further study.
