对专利权滥用的法律规制,绝大多数国家的做法是以反垄断法规制,而美国采取的是以专利法和反垄断法双轨规制。在美国国际贸易委员会(ITC)飞利浦光盘案中,ITC认定飞利浦的六项专利的专利权强制性一揽子许可构成专利权滥用而不具执行力。美国以判例法发展出较为成熟合理的“专利权滥用抗辩”原则,在专利法框架内规制专利权滥用行为,值得我国借鉴。本文由ITC飞利浦光盘案引出“专利权滥用抗辩”原则,分析该原则的历史发展、该原则与反垄断法的关系以及专利权滥用的各种类型,并提出我国专利法对专利权滥用规制的建议。
The legal regulation of the abuse of patent rights, the vast majority of countries practice the antitrust laws and regulations, and the United States is taking the patent law and anti-monopoly law double-track regulation. In the case of the U.S. International Trade Commission (ITC) Philips compact disc, the ITC found that a compulsory patent license for Philips’ six patents constitutes abuse of patentability without enforcement. The United States has used the case law to develop a more mature and reasonable principle of “abusing patent rights” and regulating the abuse of patent rights within the framework of patent law, which is worth our country’s reference. This article is derived from the ITC Philips compact disc case, “The Abuse of Patent Rights” principle, analyzes the historical development of the principle, the relationship between the principle and antitrust law and the various types of patent abuse, and puts forward the abuse of patent rights Regulatory advice.
