四川泸州情妇遗赠案判决结果作出曾引起巨大争议,对此争议至今仍未平息。许多学者就法院认定情妇遗赠违反公序良俗原则的判决持批判态度。本文试图通过介绍德国法院对于类似案件相关处理,指出法院应严格遵循“六步法”来对公序良俗原则予以具体化进而作出一个公正合理的裁判。
Sichuan Luzhou mistress left bequeathed the verdict has made a huge controversy, the controversy has not yet subsided. Many scholars hold a critical attitude to the court’s decision that mistresses bequeathed their mistakes in violation of the principle of public order and good morals. This paper attempts to introduce the German courts for the handling of similar cases, pointing out that the court should strictly follow the “six-step method” to the principle of public order to be specific and then make a fair and reasonable judgments.
