学生的受教育权和人身安全权是学生的根本权利。对学生人格的尊重,对学生权利的尊重,是现代社会人的主体性得到尊重的一个表现,是素质教育的应有之义。近十几年,我国公民的权利意识普遍提升,知法、守法、依法维权的观念正在形成。但是,在走向权利的时代,由于种种原因,学生的权利依旧会遭受侵害。如何从法律视角分析成因,研究举措以保障学生权利的正确行使,是本文研究的出发点。 Students’ right to education and personal safety are the fundamental rights of students. Respect for the student’s personality and respect for the student’s rights are a manifestation of respect for the subjectivity of the people in modern society and the due meaning of quality education. In the past decade or so, the awareness of the rights of our citizens has generally risen. The concept of knowing law, observing the law and safeguarding the rights in accordance with the law is taking shape. However, in the era of rights, due to various reasons, the rights of students will still be violated. How to analyze the causes from a legal perspective and to study measures to ensure the correct exercise of student rights are the starting points of this study.
