在海盗劫持船舶事件中,80%是以被劫持船舶的所有人向海盗支付赎金而解决的。支付赎金似乎成为了当前解决海盗劫持最不得己却最有效的手段。因此,有关海盗行为与海盗赎金的法律性质与理赔的问题日渐成为国际社会,特别是船东、货主和保险人关注的焦点。英国是世界保险业的中心,目前英国法院在Masefield v.Amlin一案中,对海盗赎金的性质以及能否将海盗赎金视为施救费用或者共同海损的问题也有了较为明确的表态,有必要对此进行一个系统的疏理。
Eighty per cent of the pirates hijacked ships were settled by ransom of the pirates by the owners of the hijacked ships. The payment of ransom seems to be the most effective means of solving the most recent piracy hijacking. Therefore, the issue of the legal nature and claims of piracy and pirate ransom increasingly becomes the focus of attention of the international community, especially shipowners, shippers and insurers.
