从治理理念出发,本文展开对信访治理的探讨,认为要应对传统信访所面临的挑战,需运用法治思维和法治方式进行信访治理,实现信访的法治化转型。信访功能的法治化是信访治理法治化的可行路径,纠纷解决是信访治理的重要功能,依法化解纠纷才能实现依法信访。在纠纷解决过程中,信访治理法治化需以程序法治为基础,增强和完善程序化特征,这包含信访“入口”的程序分流,信访“过程”的严格程序以及信访程序依法终结,从而创新社会治理,服务依法治国,迈向以程序正义为基础的法治社会。
Starting from the idea of governance, this paper starts with the discussion of the handling of letters and visits, and believes that in order to meet the challenges of traditional letters and visits, we need to use the rule of law and the rule of law to carry out the handling of letters and visits and transform the legalization of letters and visits. Legalization of the function of letters and visits is a feasible route for the legalization of letters and visits, and the resolution of disputes is an important function of letters and visits.
