近些年来,全球化及其针对全球化的讨论已成为一种研究范式、论题。尽管对于全球化本身的讨论存在众多分歧,但是不可否认的是全球化已成为我们思考问题的宏大时代背景。在当前背景下,中国传统法及其所体现的思想观念、思维方式、智慧何去何从是需要我们长期思考的问题。中国传统法本身具有独特性,我们必须摆脱那种现代化范式支配,为构建中国未来之理想进行理论性反思、试错性探求提供理论支援。
In recent years, globalization and its discussion on globalization have become a research paradigm and topic. Although there are many differences in the discussion of globalization itself, it is undeniable that globalization has become a grand era background for our thinking. In the current context, the traditional Chinese law and the ideas, thinking and wisdom that it embodies are questions that we need to think about for a long time. China’s traditional law itself is unique. We must get rid of that kind of modernization paradigm, provide theoretical support for the theoretical reflection on the ideal of building China’s future, and make trial and error exploration.
