宏观调控行为是一种新型的政府行为,其法律责任归属于经济法责任,在经济法理论研究和制度建设中占有十分重要的地位。本文以我国宏观调控行为法律责任的立法现状与责任特点为立足点,在阐释其归责原则与构成要件的基础上,提出如何实现宏观调控行为法律责任的几点建议,以期促进我国宏观调控行为法律责任的理论研究和制度建设。
The macro-control behavior is a new type of government behavior. Its legal responsibility belongs to the responsibility of economic law and occupies a very important position in the theoretical research and system construction of economic law. Based on the legislative status and responsibility characteristics of the legal liability of macro-control behavior in our country, this article, on the basis of explaining the principles and constitutional elements of the liability-attribution, puts forward some suggestions on how to realize the legal responsibility of the macro-control behavior in order to promote the macro-control behavior in our country Theoretical Research and System Construction of Legal Responsibility.
