《劳动合同法》的制定、颁布与实施受到了全社会的高度关注,该法在规范劳动用工市场、维护劳动者权益等方面起到了积极的作用,同时,随着法律运行的深入,一些新情况、新问题不断呈现。本文从司法层面出发,分析了《劳动合同法》实施后劳动争议审判领域出现的新情况,如:法律适用出现新难点、案件数量快速增长、争议类型不断翻新、新旧法衔接不畅等,梳理出了当前劳动争议审判过程中需关注的突出问题,并提出了应对当前新情况、新问题的若干意见与措施。
The formulation, promulgation and implementation of the Labor Contract Law have drawn great attention of the whole society. The law plays a positive role in regulating the labor market and safeguarding the rights and interests of workers. At the same time, with the deepening of legal operation, some new Situation, new problems continue to show. Based on the judicial level, this article analyzes the new situation in the field of labor dispute trial after the implementation of the Labor Contract Law, such as the new difficulties in the application of law, the rapid growth of the number of cases, the continuous renovation of the types of disputes and the poor connection between the new law and the old one. Out of the current labor dispute trial process should pay attention to the outstanding issues and put forward to deal with the current new situation and new issues a number of opinions and measures.
