In order to promote human rights, individuals need to turn to the courts to clarify the specifics of the rights for particular groups. When international and regional human rights standards are domesticated through the implementation of the domestic legal system, there are sufficient grounds for conducting public interest litigation. The implicit conclusion here is that the development of human rights law has seen the gradual evolution from an international system to a regional one. This article looks at the practice of public interest litigation in South Africa and discusses issues like access to justice, clinic-based legal education and legal aid to specific groups. As an example of a public interest litigation strategy, the author gave a detailed and detailed analysis of the government action against AIDS treatment and action organizations.
