地方政府由于在地方群体的利益驱动、地方制度供给的创新以及间接干预的主导性等方面都呈现出相当程度的个殊性,因而在促进其经济行为规范化的进程中也产生了相对特殊的法规范要求。本文以地方与中央政府的分层化为前提,提出在将地方政府的经济决策和经济执行行为相分离的基础上,通过有针对性的法律规范来规制地方政府的经济行为。
Local governments, due to the interest driven by local groups, the innovation of local institutional supply and the dominance of indirect intervention, all have a considerable degree of certainty. Therefore, they have also produced relatively special laws in the process of standardizing their economic activities requirements. Based on the stratification of the local government and the central government, this paper proposes that the economic behavior of the local government should be regulated through the targeted legal norms based on the separation of the economic decision-making and the economic execution of the local government.
