《鹿特丹规则》设置了第82条和第89条两个冲突条款,分别协调其与既有非海运公约的冲突及与海运公约的冲突。《鹿特丹规则》第82条采用的是前法优先机制,通过让位于既有非海运公约的方式较彻底协调产生的条约冲突;第89条采用缔约国退出先订条约的机制,试图取代既有三大海运公约从而达到统一国际海上货物运输合同法的目的。《鹿特丹规则》中的冲突条款由于设计上的缺陷,不仅无法通过冲突条款的设置达到协调国际货物运输公约间的冲突,在某种程度上将加剧这种冲突。
The Rotterdam Rules set forth the two clauses of conflict between Article 82 and Article 89, which respectively coordinate their conflicts with the existing non-maritime conventions and their conflicts with the maritime conventions. Article 82 of the Rotterdam Rules adopts a prioritized mechanism of priority through a more complete coordination of treaties arising from the modalities of existing non-maritime conventions. Article 89 adopts the mechanism by which States parties withdraw from the first treaty in an attempt to replace the existing three Convention on maritime transport so as to achieve the purpose of harmonizing the international contract of carriage of goods by sea. Conflict provisions in the Rotterdam Rules Due to design flaws, not only can conflicts between the international conventions on the carriage of goods be coordinated through the conflict provisions, but they will be exacerbated to some extent.
