虽然法律科学早已注意到立法活动中有关社会学方面的问题,但“立法社会学”这一术语却是不久前才引入苏联法社会学科学流通领域的。苏联法社会学学术讨论会的多次召开,大大推动了把法的创制中各种社会学调查都纳入立法社会学范畴的愿望。法国学者的观点很有代表性,例如卡尔波涅在著作中把立法应用社会学划分为两大类:一类是对立法活动机制(考察这一机制时不涉及立法活动的内容)的研究即所谓的“立法的外部社会学”;另一类是以法律内容本身为客体的研究即“立法的内部社会学”。在外部社会学范围内,作者又分为两类:法律制订前就有的即立法前的社会学(其任务是针对立法中的变化做心理学方面的准备工作)和立法后的社会学,任务是解释已通过的法律。
