根据我国现行《民事诉讼法》规定的基本原则的体例十分混乱的状况,试图在分析《民事诉讼法》的功能及特征的基础上,提出新的识别标准,进而依此剔除现行《民事诉讼法》中不适格的基本原则并引入其中未有的有益原则,从而重构我国《民事诉讼法》的基本原则,只有这样才能使《民事诉讼法》的基本原则更加符合当前的社会情势,发挥其应有的功效。
