问题某项目建设需占用农村集体土地,当地政府组织有关单位与村集体经济组织签订《土地征收补偿安置协议》,随后组织用地单位开工建设。经查,此项目并未获得征地批准文件。请问:建设项目实施中能否先签后批,签订协议后能否进行开工建设?解答一、征地补偿安置协议一般属于批后实施程序目前,《土地管理法》和《土地管理法实施条例》对签订征地补偿安置协议都未作规定。
