知识产权的国际保护始于19世纪,是资本主义自由竞争和商品经济发展的需要,因而知识产权的地域性特征基本上符合资本主义的历史发展。然而,到19世纪末期,自由资本主义走向垄断资本主义,垄断资本家在大量输出商品的同时,也尽量输出资本和技术,由于工业革命的兴起和科学技术的进步,国际商业贸易与经济交往日益扩大,智力作品和科技成果的交流在世界范围内日趋加强,从而知识产权的国际市场也逐步形成。在这种情况下,垄断资本主义为了摆脱知识产权地域保护的限制,维护其垄断地位,扩张其国际市场,便迫切要求建立知识产权的国际保护制度,以期获得最大的市场份额和最高的利润。

Due to the rise of the industrial revolution and progress in science and technology, international commercial trade and economic exchanges have been expanding The exchange of intellectual works and scientific and technological achievements has been increasingly strengthened around the world, and the international market for intellectual property has also gradually taken shape. Under such circumstances, in order to get rid of the restriction of regional protection of intellectual property, monopoly capitalism maintains its monopoly position and expands its international market, it urgently needs to establish an international protection system of intellectual property with a view to obtaining the largest market share and the highest profit.
