预告登记制度,是对原债权人以不动产物权变动为请求权的债权进行保护,是不动产登记中的一项重要制度。界定了不动产预告登记的概念,对预告登记所的请求权的法律性质、预告登记的法律要件、适用范围,法律效力、消灭等方面进行考察与分析,对预告登记制度的理论和实践以及与我国法律制度的整合进行了较为深入的探讨。我国《物权法》中对预告登记进行了规定,但仍存在不足,需对该制度具体实施制定操作细则,对我国预告登记的发生要件、适用范围、法律效力、消灭等方面进一步明确规定和完善。
