自由是现代社会发展的动力,是公民权利的基本内容;秩序是社会发展的前提,是国家权力的重要体现。自由与秩序毫无疑问是人类关注的核心价值坐标。保守主义哲学秉持多元、传统、务实的基本信念,对自由和秩序的平衡有着更为现实和理性的考量。当下中国处于利益主体呈现多元化,利益矛盾呈现复杂化的历史激荡期,法治中国建设进程中面临一些理念陷井。公民权利的保障和公共权力的行使一定程度上存在冲突和博弈,法治社会的推进需要构建一种审慎的自由观和宽容的秩序观。
Freedom is the driving force for the development of modern society and the basic content of civil rights. Order is the precondition of social development and an important embodiment of state power. There is no doubt that freedom and order are the core values of human concern. Conservative philosophy upholds the basic conviction of pluralism, tradition and pragmatism and takes a more realistic and rational consideration of the balance between freedom and order. At present, China is in a period of historical agitation in which the main interests are diversified and the contradictions of interests appear complicated. There are some pitfalls in the process of rule of law in China. To some extent, there exists conflict and game between the protection of civil rights and the exercise of public power. The promotion of a society ruled by law requires the construction of a cautious concept of freedom and tolerance.
