个案急呈:叶某于2006年3月17日被某煤炭公司招为职工。2011年8月20日,叶某在工作中负伤,被鉴定为伤残四级。2011年年末,单位通知叶某,要与其解除劳动合同,一次性给予经济补偿。叶某不同意,认为本人已经工伤,单位不能再解除合同。但单位认为申请人是农民工,应当退出工作岗位,可以解除劳动关系。最后单位不顾叶某的反对还是向其下达了解除劳动合同通知书。无奈之下,叶某向当地劳动人事争议仲裁委员会申请了劳动仲裁,要求裁决单位解除劳动合同行为无效,恢复双方劳动关系。
