由于历史和现实的原因,在双边投资条约(BITs)实践中,长期存在发达国家与发展中国家之间在谈判地位与能力、谈判目标与效果、权力与利益等方面的不平等或不平衡现象。近年来,此种不平等或不平衡现象呈现强化和扩张之势。本文主张,国际社会特别是发展中国家应积极探索BITs实践的革新路径,包括推动国际组织起草新型BITs范本,在发展中国家相互之间BITs实践中形成和发展新的法律概念、规则和标准。作为最大的资本输入国和潜在的重要资本输出国,中国在创立新型BITs中大有可为。
Due to historical and practical reasons, in the practice of BITs, there are long-standing inequalities or imbalances between the status and capabilities of negotiation, the objectives and effects of negotiations, power and interests between developed and developing countries . In recent years, such inequalities and imbalances have shown the tendency of strengthening and expanding. This paper argues that the international community, especially developing countries, should actively explore ways of innovating BITs practices, including promoting the drafting of new model BITs by international organizations and the formation and development of new legal concepts, rules and standards in the practice of BITs among developing countries. As the largest capital-importing country and potential exporter of important capital, China is promising in creating new types of BITs.
