刑法作为维护正常社会秩序的最后防线,在劳动者的职业健康权方面起到非常重要的作用,为更好地保护我国劳动者的职业健康权,本文列举我国当前职业病危害控制的现状,分析引起当前现状的原因,以及现行刑法对保护劳动者职业健康权方面的不足之处,认为修改现行刑法立法以及相关司法解释十分必要,有利于调节当前我国经济转型期在职业病防治方面的劳资矛盾。
As the last line of defense in maintaining normal social order, criminal law plays a very important role in the right to occupational health of laborers. In order to better protect the right to occupational health of laborers in our country, this article lists the current situation of occupational hazard control in our country, The current status quo and the inadequacies of the current Criminal Law in protecting the occupational health right of the workers, it is necessary to amend the current criminal law legislation and relevant judicial interpretation, which is helpful to adjust the current labor conflicts in the current period of economic restructuring in our country.
