在新的时代,我国军队越来越多地参与抢险救灾、维稳处突等非战争军事行动,成为我国应对突发事件的重要主体和关键性参与者。我国的《突发事件应对法》奠定了军队参与突发事件应对的法律框架,但欠缺相应的具体的法律机制。军队参与突发事件应对,应以预防突发事件为主,并为此努力建构和持续完善突发事件预防与应急准备的法律机制。我们不仅应当建立军队的应急训练机制,而且应当建立军地之间的应急交流机制和应急培训机制。有关军队应急预案的制定和修改,亦应作强制性规范。出台专门的军事法律或配套相应的军事法规,辅之以补充性、执行性的军事规章及军内规范性文件,是解决上述问题的关键。
In a new era, the Chinese military is increasingly participating in non-war military operations such as emergency relief and disaster relief and stabilization of military operations, and has become an important subject and a key participant in our country’s response to emergencies. China’s “Emergency Response Law” laid the legal framework for the PLA to respond to emergencies, but lacks the corresponding specific legal mechanism. The armed forces should take the initiative to prevent emergencies and strive to construct and continuously improve the legal mechanism for emergency prevention and emergency preparedness. We should not only establish an emergency training mechanism for the military, but also establish an emergency exchange mechanism and an emergency training mechanism between the military and the military. The formulation and revision of contingency plans for the military should also be made mandatory. The promulgation of special military laws or corresponding military regulations, supplemented by supplementary and enforceable military regulations and military regulatory documents is the key to solving the above-mentioned problems.
