医疗事故鉴定、医疗纠纷处理的办法和体制,在过去的年代里为我国的医疗事故鉴定和医疗纠纷的处理起了十分重要的作用,为稳定医疗秩序作出了积极的贡献。但是,随着改革的深入和市场经济的发展,原来的医疗事故鉴定、医疗纠纷处理的有关规定和体制已经逐渐暴露出越来越多的弊病,难于及时、客观、公正地协调和解决众多的医疗事故鉴定的申请和医疗纠纷的调解。从现实情况看,一些医疗纠纷已经严重地影响了医疗卫生部门的正常工作,甚至个别医疗纠纷由于用现行体制和方法难于调解平息,不仅将政府有关部门的精力大量地牵涉进去,而且对社会稳定带来了威胁。因此,医疗事故的鉴定和医疗纠纷的处理,在机制和体制上的改革迫在眉睫,非改不可了。
