海外加强金融消费者保护的举措可以总结为以下十个方面:用“投资商品”或“金融商品”的概念整合传统分类;“功能监管”;“复杂投资产品”与“冷静期”制度;在坚持“披露为本”的监管理念的基础上,更加重视风险揭示;“公平对待客户”计划;打破形式公平原则,引入适合性原则,加重金融机构的责任;成立专门的金融消费者保护机构;在传统的诉讼和行政当局的调解之外,建立民间的金融督察或调解机制,为金融消费者提供快捷、低廉甚至免费的纠纷处理渠道;加强金融消费者教育;举证责任倒置。以上十个方面的措施,体现了一个理念:对金融消费者实施倾斜保护的理念。体现了一个转型,即传统金融法正向金融服务法转型。现代金融法就是金融服务法,金融服务法就是金融消费者保护法。
