在法理上 ,职务犯罪具有渎职性、隐蔽性、危害严重性以及连带性等特点。其产生原因是多方面的 ,既有公共权力与人性的局限 ,也有宏观的社会背景的影响 ;既有现行的制度上的偏差 ,还有行为人自身素质方面的原因。因此 ,必须多渠道预防和控制职务犯罪的发生和蔓延 ,具体地 ,应通过道德控制、社会控制以及司法控制等多元化途径进行综合治理
In jurisprudence, job-related crimes have the characteristics of dereliction of duty, invisibility, seriousness of the harm, and relatedness. Its causes are many, both the limitations of public power and human nature, but also the impact of the macro social context; both the existing institutional bias, as well as the reasons for the actor’s own quality. Therefore, the occurrence and spread of job-related crimes must be prevented and controlled through multiple channels. Specifically, comprehensive treatment should be carried out through a variety of channels such as moral control, social control and judicial control
