从犯罪主体所在单位而言,公安机关工作人员是徇私枉法犯罪的重灾区,占样本数的87.5%;在公安机关内部,犯罪主体属于县(区)级以下公安机关(机构)的工作人员占样本数的76.3%。应当立案而没有立案的占样本数的38.9%。如何及时有效地加强对公安机关的立案监督成为摆在检察机关面前的一项重要课题。增加线索来源是开展立案监督工作的重要前提;建立科学合理的业务考评导向机制是加强立案监督工作的重要条件;完善相关法律和可操性的制度性规定,加强顶层制度设计,畅通检察机关的监督渠道,建立报备案制度、完善行刑衔接平台是推动立案监督工作的根本举措;严格责任追究是从源头上减少“当立而不立、不当立而立”立案违法行为的重要保证。

Strict accountability is an important guarantee for reducing the number of illegal activities.
