军事立法关乎国家、政府、军队、社会组织和个人多个权利主体的利益,所体现的权利和义务关系具有复杂性和多样性。军事法律制度要蕴含合理的经济理性,需要应用资源的稀缺性、主体行为的外部性和主体资源的有限性、主体诚信有限性等有关经济学理论来反映社会经济关系赋予军事法律制度的规定性。军事立法的经济学分析路径应遵循以下几个方向:军事权力与军人权益配置效率最大化,军事法律责任预防最优化,军事法律程序成本最小化等。这样研究的目的是达到:军事行为主体的对策行为均衡以促进合作、保障合作,军事立法多目标博弈均衡。
The military legislation concerns the interests of multiple subjects of rights of the state, the government, the army, social organizations and individuals, and the relationship of rights and obligations embodied therein is complex and diverse. The military legal system should contain reasonable economic rationality, which requires the application of the scarcity of resources, the externality of the main activity and the limitation of the main resources and the limited integrity of the main body to reflect the stipulation that the social economic relations confer on the military legal system . The path of economic analysis of military legislation should follow the following directions: the maximization of efficiency in the allocation of military rights and services, the prevention and optimization of military legal responsibility, and the minimization of the cost of military legal proceedings. The purpose of such a study is to achieve a balanced game of the countermeasures and actions of the main actors of the military in order to promote cooperation and ensure the multi-objective game of cooperation and military legislation.
