With the extensive development and application of e-commerce,third-party payment has gradually gained a huge market.Different from other payment methods,third-party payment can realize a variety of interactive functions between merchants and multiple Banks through only one account.Such as payment and settlement,cash flow,short-term insurance and guarantees.However,some problems have emerged along with the convenience of third-party payment transactions.First,there will be problems in the process of payment transaction.Third-party payment is an indirect means of payment by which the buyer and the seller first transfer funds to an account opened on the platform and then transfer them to the seller’s users through the platform.When the payment occurs,there may be a payment defect due to the buyer or other non-human reasons,which mainly refers to the situation that the platform transfers funds based on wrong instructions due to the incorrect delivery of payment instructions.Second,the third-party payment institution plays a neutral role in the transaction except the buyer and the seller.It is not the main body of the transaction but is responsible for the transfer of funds in the transaction.This means the third-party payment institutions hold funds for a short time but not the ownership of the funds.Due to the lack of the third-party payment institutions and the scale of funds corresponding to the return of the profit model,in this huge temptation is likely to appear the risk of embezzlement.Finally,because the operation of third-party payment services requires a strong professional background and technical support,once the financial security of consumers is damaged,due to the existence of technical and professional threshold,consumers will be in a negative situation,not conducive to rights protection.In addition,due to the short development time of e-commerce,the legislation for the special industry of online payment in the protection of consumers’ rights and interests in China is relatively scattered,and the protection against fund security is not targeted.In order to ensure the financial security of consumers in the third-party payment,it is necessary to solve the above three problems.This paper will combine the concept of third-party payment and its operation process to solve the above problems.Firstly,from the perspective of problems,this paper analyzes the problems in payment process,precipitation funds and realization of rights and their causes.Secondly,through the comparison of relevant industries and relevant countries’ relevant systems,the advantages of relevant systems are sorted out and combined with our practice.Finally,according to the situation of our country,and puts forward three possible solutions: to solve the problems in the payment process by standardizing the responsibilities and obligations of the payment platform and the scope of user losses;to solve the problem that precipitation funds are easy to be misappropriated by improving the account classification and establishing the insurance system,and to effectively guarantee the realization of user rights by establishing a diversified dispute resolution mechanism.
