《劳动合同法》第22条规定,用人单位为劳动者提供专项培训费用,对其进行专业技术培训的,可以与该劳动者订立协议,约定服务期,劳动者违反服务期约定的,应当按照约定向用人单位支付违约金。这里的专业技术培训应有别于企业平常对劳动者进行的职业培训。在用工过程中,用人单位为了提高劳动者的劳动技能和劳动熟练程度,使之更好地为单位服务,经常需要对劳动者进行职业培训,此类职业培训也是《劳动法》赋予用人单位的一项义务,用人单位不能因向劳动者提供了职业培训便
